Getting your money back

This is coming from my personal experience. 4 years ago I was in the same boat, I bought a cellphone for 180 dollars from a seller with enough positive feedbacks. Early on it was easy to communicate with him through email, until of course I noticed that it was taking some time for the package to arrive (I paid by money transfer). That was the time that he also stopped replying to my emails. I used ebay's resolution feature and another resolution site (the name escapes me at the moment) but to no avail. I was ready to accept the reality that I was never going to see my money nor the phone until my friend told me not to take it sitting down. Per his advice, I sent the seller another email, this time telling him that I was now hiring the services of a lawyer to take care of the case. He promptly replied saying that he did send the package. But as my friend told me, until the package is actually in the buyer's hands, then it's still the responsibility of the seller. The outcome of this story is that I did get my money back.
