Unlocked Sony Ericsson Phone without a data plan?

Hey Guys,
I'm new to phones and am looking for a smartphone (unlocked) because my HTC Freestyle is such a pain and always restarts. I currently am with AT&T
I contacted a Sony Ericsson representative and she told that if I purchase any unlocked smartphone I will not have to pay for a data plan. Is this possible?? I've been researching and have found many conflicting answers.

Some unlocked phones might be detected as a smart phone, but some do not. There are no guarantees either way. The general rule of thumb is that if it was never carried by At&t it won't be detected. Good luck. Post what model you are thinking of getting for more feedback. It is getting harder to fool the billing system than it did in the past.

...that there is *no* guarantee that ATT won't send you the mandatory 'smartphone data plan' text message. It will be trial and error unfortunately.

I suggest perusing howardforums for more specifics on what may have worked recently for someone. Compare plans and features to know if you resemble their situation.

Keep in mind that most of the unlocked Nokia smartphones available via amazon work fine for what you want to do.

Further clarification

For instance, I was using a Sony Ericsson P810 (using Symbian 60 OS) for 2 years on At&t from 2004-2005, but back then At&t wasn't as picky about smart phones as they are today.

I know by today's standards that phone was primitive, but it was a hybrid PDA/phone with a large touch sensitive screen.
