Some folks are unsafe while driving and conversing with a passenger (no phone). They LOOK at the passenger, ignoring the road. I've seen it, and I'd be honestly surprised if you haven't.
If someone's incompetent, don't license them. Why penalize others for the lower 2% of the bell curve?
I have logged close to two million miles. I've had mobile phone service (pre-cell), business and ham radios, CBs, FRS and GMRS, as well as cellular and PCS telephones. I've never had an accident while operating any of these. Not even a close call. But if traffic conditions are bad, I either pull over, hang up, or keep it short 'n' sweet.
I've had accidents, though. A teenage hotshot in his Camaro blindly forcing his way across a non-signalled intersection of W. Olympic Blvd during rush hour, an old lady who turned left into me (and didn't remember the accident the next day), someone cutting across two lanes to make an offramp (I was in the 1st lane), and in NONE of these instances was I using any 2 way radio or phone (which is a 2 way radio).
If YOU can't handle a phone and automobile, by all means pull over to a safe place (not the side of the freeway - that's NOT a safe place). If you SEE someone driving recklessly while conversing (or not), get their license (safely, mind you!), call the police or hwy patrol, and report them. But making conversations in cars illegal is throwing out the baby with the bath water. It's unreasonable, and unreasonable laws lead to disrespect and disregard for the whole law.
