getting photoshop from friend

I have a general question. I have a friend who asked if I wanted to purchase a copy of their CS3 software for $50. Isn't this really illegal and they could get into alot of trouble as well as I if I purchase it?

If he's selling it outright...

It would be legal if and only if:
1.) He legally purchased the license he is selling you.
2.) The license is not OEM, NFR, etc.
3.) He uninstalls it from his own computer before selling it to you.
4.) He destroys every copy of Photoshop he has related to that license, or turns them over to you.
5.) He does not purchase/use an upgrade edition based on the pretense of owning the copy he's selling you.

Otherwise yes, it's considered piracy (illegal), and yes, there are repercussions for all parties involved.

I've questioned him on this and he seems to think it's ok. It really bothers me as I think he has sold to others. He has not purchased multiple licenses, or uninstalled. Should I report this to someone? Thank you for your advice I truely appreciate it, just not sure what to do about it or just ignore the elephant in the corner.

Adobe has a method for reporting it...

Much like he would not appreciate you creating and distributing duplicate copies of a check he wrote out to 'Cash,' Adobe doesn't appreciate the duplication/distribution of their software without reimbursement. If he is indeed selling the same license repeatedly I would report it by using the form at http://www.adobe.com/aboutadobe/antipiracy/reportform.html, which allows you to remain anonymous if you choose.

If it is a friend I'd choose to tell him what you think about it and then simly not get involved in what he does. I mean, you can be friends on other levels I would think...
