If you have a full t3/ds3 you have 45m.
Never have had a big issue with ATT support on their commercial stuff like this.
First you must be very careful how you are testing. With a point to point circuit you are guaranteed by contract the speed. This means with a full t3 you will get 45mbit/sec in both directions at the same time to ATT location. So in theory you should be able to run a upload and download test at the same instant and both would show 45m.
I am sure they can show you the reports from the line test that prove it. You problem is you would need a speed test server in the same location at ATT router for them to be able to guarantee anything.
In general what I have seen from any large ISP is you buy a connection like this to one of their data centers. This places you on their main backbone. As long as you stay on that provider you will get excellent response.
The issue you have with so called speed test servers is they may buy their internet from "cheapo ISP" . You now have the problem of how does ATT connect to the other ISP. You also do not control the test server so the results mean little.
Call the att commercial service line, you may have chosen the wrong option in their menu. You should get 24x7x365 support on this type of circuit.
