As of 12/27/2012 this issue remains a concern.
Several 60ES8000's were returned yesterday (12/26/12) due to this issue. We contacted Samsung direct and were assured an update was out. We were then told to reset SmartHub on both televisions and then let it automatically update SmartHub. Unfortunately that did not resolve the issue. After contacting Samsung's Tech support back with the results, the tech then took over control of one of our televisions. The tech did exactly what we did and the issue was still there. I have contacted our neighboring district stores. There have been "Lots" of Samsung Smart TV returns on the day after Christmas from complaints of this issue.
I also noticed that there were many complaints of purplish tinted blacks with the 60ES8000 model series. I hope these issues gets resolved soon. We did confirm and report the purplish blacks on the returned televisions. The tech mentioned there is no current fix to this issue.
Also worth a mention. It has come to our attention that Samsung also deleted an option called Cinema Black from this years ES8000 series. A few returns were from customers complaining about this as well. From what we can tell, Cinema Black turns off the LEDs on the top and bottom portion of the letterbox bar area so the black bars maintain a deep solid black color. Oddly enough, its on this years ES9000. Perhaps the evolution kit upgrade will bring this requested feature back onto the ES8000 series.
