What an absurd TOS. You can't put a file online and then tell people how they're allowed to access it! That's having your cake and eatting it too...
I'm guessing it has something to do with the ads. They probably don't embed those in the FLV files. and add them later through the web interface (so they stay accurate).
Same for Youtube. See there TOS in http://www.youtube.com/t/terms
5B. You may access User Submissions for your information and personal use solely as intended through the provided functionality of the YouTube Website. You shall not copy or download any User Submission unless you see a “download” or similar link displayed by YouTube on the YouTube Website for that User Submission.

If you think they can't do it (you seem to say so): immediately call your lawyer and start a class action.
