Because if it is shipping from New Jersey to where you are (I won't mention it but it's in your profile) via UPS Ground, you should be getting right away, unless there are weather issues. You are both in the same UPS shipping zone, in neighboring states. Because of this, you should be getting it the day after he ships, by the end of the day. Shipping time excludes weekends and holidays - President's Day (Feb. 19) is not considered a holiday for UPS.

So I don't know whether or not to believe him. If it is coming from New Jersey (his listing notes this), and it is supposed to be there on the 23rd, then he hasn't shipped it yet.

However, he does state "Please allow 6-10 business days for delivery", which hasn't passed yet. Starting from the 6th, only 8 business days has passed. Weekends don't count. You could give him the benefit of the doubt since he's had the flu, and give him until the 23rd. After that, you could more aggressively pursue a refund.

I'm just wondering why did you buy it from eBay? Why not Amazon, Walmart, Circuit City, Best Buy, etc? From the looks of it, the price you paid isn't any less than from a reputable e-tailors I just mentioned. In fact if you search around for coupons you can get an XBOX 360 Premium for about $370.

From reading the threads, I think you need to relax just a little and wait a bit. The time lines haven't expired yet. And if so, get a hold of EBAY security, they will take it from there.

i agree with the guys, get the tracking # asap so you can check if it's valid and check if it's in transit.

if the seller doesn't provide you one after the estimated delivery date, make sure to report him on Paypal if you paid that way. don't forget to report him on Ebay to initiate a dispute which usually results in the seller responding because Ebay notified them.

i've been scammed before but i managed to get my money back from my CC company after reporting it. good luck.

Just because an item is late does not necessarily mean you have been scammed. However, as some people have mentioned there are things you can do to protect yourself moving forward should this prove to be a scam. Both E-Bay and PayPal (assuming you used PayPal) have strict time limits for filing complaints. I think the time is thirty days but you should check to be sure. If I were you I would send a nice e-mail and simply explain to the seller that in order to protect your rights you will have to initiate dispute resolution procedures within the time allowed, regardless of whether he is sick, etc. Unfortunatly, if you have been scammed E-Bay and PayPal are actually not that helpful (frankly PayPal is only helpful if the seller has a credit balance at the time PayPal rules in your favor and if this is a scam there will be no credit balance.) Do not dispair, however. I am an attorney and helped a friend get back over $1,000.00 he actually wire transferred to someone (EBay discourgages this type of payment) for a Viao computer. When dispute resolution was ignored by the fraudulent seller, I sent them a series of e-mails cc'd to the FBI, local police and other agencies with internet fraud units and made it clear that the matter was going to be pursued to a conclusion. After doing some research and finding out some information about the seller, we made a final demand for the entire sum back by a date certain or else all resourses at our disposal would be used and the FBI and state a local authorities would be requested to proceed with their investigations of the internet grand theft. Sure enough the money was wire transferred back before the date specified with some lame excuse that the whole thing was a misunderstanding. Hopefully you just need to give your seller a little time break for sending the item to you. In no event, however, allow this to extend past 30 days without filing your complaints with EBay and PayPal (if applicable) and let the seller know in a nice way that you have to do so to protect your rights. If it turns out you have been scammed just don't give up on trying to convice the seller that sending your money back will be a lot easier than fighting over it. Frankly most of the scammers never get caught because the buyers do not know what they can do besides leaving bad feedback. However, if pushed scammers do not want to be investigated and while the cost of an XBox is not going to get you an attorney or very far in pursueing the matter just don't forget that their are government agencies set up to combat internet fraud which may be willing to help and if you know the City where the seller lives you can even contact local authorities or at the very least get on the internet and find out the e-mails of the FBI and the local authorities and cc them on your demands for your money back (this is true even if you have never contacted the FBI or local authorities because the scammer does not know that). At least keep the scammer aware of what you are planning (without making any threats or lying) and hopefully they will realize that in the long run it would be easier to simply return your money. By the way, another E-Bay scam to beware of are second chance offers made by people impersonating sellers. This is very common and usually involves high end electronics and computers. Unless a second chance offer appears in the e-mail section of your EBay home page, it is not valid. This is how my friend got scammed on the notebook. He received a very authentic looking e-mail in his outlook account offering him a second chance to purchase a notebook he had bid on and which the high bidder allegedly refused to pay. The e-mail looked very real, and the address was from something like "second-chance@ebay.com". I hope more people become aware of this scam and I tend to let people know about it whenever I can. How does he give me a full refund. Also, the item had paypal buyer protection up to 1,000 dollars, am i eligible to get more back than I payed since i payed less than $1,000. Just to tell you, i am not greedy, my mom is wondering.

"up to $1000" doesn't mean they will give you $1000 dollars if you lost $1. They would only refund what you lost but if it was over $1000 then they will stop there.

You used PayPal right? He can just send the money back to you.

FYI - eBay fraud is sometimes considered a FEDERAL crime (much more serious) if the seller's fraudulent activity includes misuse of US postal service.

about PP refund

if he decides to refund you in paypal, you will be notified by the email you registered with paypal about receiving a refund.

if you paid with a credit card in paypal, the money wil be credited to your CC account. if you paid with a bank transfer, then it should be credited to you PP balance.

if you don't receive anything within the time limit of the dispute, keep the dispute open. PP or Ebay will eventually refund you if the seller doesn't respond. make sure to email him again about a refund and see if he responds. if he's not helping you, make note of it in the Ebay dispute console.

it seems like you got a bad seller who is trying to drag out the dispute so it'll expire. don't let that happen. i've been through this before so i know how it all works. good luck.

PayPal Dispute Process

If you paid through PayPal and opened a dispute then you have twenty days to come to a amicable solution. If the seller has not refunded you within twenty days, you need to escalate the dispute to a claim so that PayPal can investigate. Since the transaction is eligible for PayPal Buyer Protection, you will receive a refund even if the seller does not have the funds in their account, up to $1000.00 USD.
