We need to avoid creating a slippery slope into a torrent of laws. This is America not a communist country!

Talking on a cell phone, eating a meal, putting on make-up or doing a myriad of things while driving is dangerous; but some people can do it just fine. I do not look for people talking on their cell, but when I see someone driving dangerously, more often than not they are talking on their cell and are clueless to the rest of the traffic.

What I want to see is a LAW that TRIPLES the fine for someone who is talking on their cell phone while committing the offense. So, if running a red light is normally $150; do it while on the phone and it costs $450. Do it too often and lose your driving priveldge altogether. This way those who can drive and talk (or eat or whatever) can continue to do so without penalty. Simply passing laws to prohibit talking & driving is not a good idea.

Driving is a full time job. When you use a cell phone while driving, you become a partime driver. You cannot drive safetly while using a cell phone. The should outlaw cell phones while driving. They should park the car and then talk on the cell phone, when finished, then start driving again.

I think most people are seriously irresponsible and careless. They aren't the multi-tasking individuals they think they are. I was nearly hit by someone who thought they could talk and drive.........he wasn't even aware I was there. That's really sad and scary.

Some people just don't drive properly

Here in Colorado, there are some air-heads who can't multi-task when behind the wheel - their careless driving can be a pain. However, the biggest problem is the reckless driving of the agressive drivers who drive like they're in a stock car race. Those bigots should be placed in front of a firing squad!

I see plenty of drivers not paying attention in other ways than cell phones,
like getting dressed, eating, reading, trying to control kids, so I propose this. Training, drivers ed for cell phone use. Make everyone who has a cell phone take it. There is no reason to ban it because of a few lousy drivers. You scream when your stuck behind a car full of children and the mother is not paying attention to the road. So what is the difference? Cell phones are an easy mark, its one thing not many different things.
I bet if you count all the cell phone users then count all the bad ones on a stretch of hiway you'd find its a small percentage who drive poorly.

I don't know about the States, but here in the U.K., eating, drinking, lighting a cigarette etc is ALREADY an offence; 'Driving Without Due Care and Attention'. It's a catch-all piece of law.

I would be very surprised if there isn't similar legislation in the States.

Using a mobile phone is slightly different in that is is specifically legislated against and carries an on-the-spot fine.

When a driver causes a wreck because he was fiddling with the radio, eating, talking to a passenger, or whatever it's not usually as obvious as when talking on a phone. Cell phones are an obvious target for people wanting to have an easy solution (blame) for a problems, and for politiicians to say they are doing something about the problem. If even hands free devices are as dangerous, then it's definately at least as dangerous to talk to a passenger, and probably even to sing along with the radio.

It is illegal to do this without a hands free in all states of Australia. People still do it but there are largish on-the-spot fines and loss of points which could result in the driver losing the driver's licence.

For some people even talking whilst driving should be illegal. My wife mainly.

.. interesting post, mate! I tend to agree with your wife's logic - ANYTHING that distracts you while driving is dangerous!

Of course, that is just an academic point-of-view... fact is, some people really DO tend to get distracted far more easily.

Law against driving and talking

In South Africa we do have a law againt talking and driving - with you phone in the hand - of course! A fine to up to $200 (converted currancy) can be given - provided that the police see you! It is enourmous frustrating to try and drive while the talkers clearly do not concertrate on the road: they drive slower, do not keep in the lanes and do not give proper signals when turning.
With the most mobile phones per capita in Africa we do need this law. (I never thought the RSA would beat the USA on any thing... - this law did!)

Holding the phone DOES make a difference

We also have a law in Washington, DC but I still see many drivers holding their cell phones while talking. I used to drive that way until one morning I realized how poorly I was driving during a conversation in rush hour -- yup, slower than I should be and barely staying in my lane. There's something about holding that phone that draws more concentration away from driving. Bluetooth makes it easy -- and if you have a traffic emergency, you have both hands free.

You're right -- as you drive down the road you can tell the ones who are oblivious to how poorly they are driving -- they're all over the road and driving extra slow and not aware of any other cars on the road.

The voting shows a majority for there ought to be a law against it..In Australia there already is.
