They are all on the list for good behavior to do hard labor. I say prison, fine, and a ban on using technology.
I knew a guy who hacked the police dept and he suffered the most from being banned from the rapid pace of technology.
He was not allowed to even be around a computor.
This was back during the time of the original Radio Shack specials. He was a geek and suffered immeasureably.
I'm not willing to pay tax dollars to immure these folks in prison; but neither should they go free. They should be required to spend at least 5 years doing service REMOVING viruses and reprogramming computer systems that they have damaged - I've had to rebuild my setup - it takes TIME and is frustrating. They should, also, have to make public appearances explaining the danger of running without virus protection and promoting whatever virus software is out there that eliminates the viruses they created. They must, also, wear an ankle bracelet that identifies them whenever and wherever they logon to any system - tracking their computer activity to monitor that they're doing their service and not creating more havoc.

In my Love and Logic class they talk about making the consquence (punishment) approprate to the action (crime) So I think they should do service and resitution. It could work like this. 1st offense, Five years of Minimun wage work (don't want the to get rich) finding cures and tracking down software virises and creating anti-virus software programs (this would include NO licesing rights or pattons rights on any of their work) as well writing individual appology messages to all the people they had hurt and paying for all of the postage(no e-mail) . 2nd offense 10 years of the same but they now have to personally meet and apolize to everyone they caused problems to with his program. This should keep them busy! 3rd offense 20 years in prison with NO access to a computeror any computer information from library or visitors. By the time they get out (hopfully) their computer knowledge will be so out dated their not a threat to us.

Destroying property of the value of home and business computers is a felony. Across state lines in a Federal Felony and merits a minimum sentence of 10 years in prison and $10,000,000 fine.
Go medieval (low tech!) - boil them in oil.
Fines should be commensurate with the amount of damage caused by the virus/worm. People who write viruses that cause millions of dollars in lost work time, etc. should be hit with a REALLY big fine--and if it bankrupts them, fine. Maybe they won't be able to buy more computer systems to hack with!! Perhaps the cash from the fines could be invested back into police units that focus on computer crime--that way, the more fines that are imposed on virus writers, the more cybercops there are.
But fines shouldn't necessarily rule out jail sentences, either. White collar crime is still crime--and viruses certainly wreak havoc in our soceity.

they should be given a virus....I suggest something that produces genital warts.
After a prison term commensurate with the loss and bother they've caused, and a fine likewise severe, they should be introduced to the community of ordinary people who find normal life a struggle enough without malicious impediments being placed in their path. For community service, they might be required to serve in the organizations that have been impacted by the viruses, etc. doing, for a year or so, spell checking of the letters and reports of that organization. Also for a period of time, they might teach elementary school students (and their teachers) how to use the computer. And then they might go grocery shopping for homebound old people, and help around the house.
I have something in mind, but it's too explicit to say; it involves them being bent over a barrel and the rough end of a pine-apple.
Fining these creeps won't matter that much. Most likely they have a rich parent more than willing to pay the fine. And if they are of age, they wuuld have to make the fine enormous and then send the person to jail if they could not pay it.
But ultimately I think they should spend a considerable amount of jail time. They often cause hundreds of thousands of dollars, which is equivalent to grand theft or worse. They should also have to pay restitution for proven damages.

I would say it depends on how serious the virus and what level of damage was caused. Like the punishment fit the crime.
Depending on the level of damage done by the viruses created, is how the level of fines to levy to the criminals. If the amount is too much for the convicted to pay, then prison & if a 2nd conviction, then directly to prison, no matter the amount. Though, having said this....prison w/out alternative to pay for crime would set a more immediate deterent for others....no computers in prison & if viruses get on them, if they did have them, then hopefully, the convict would get the &$%* beat out of them!!
